SJ CREATIONS LABEL DESIGN CONTEST

2011 OFFICIAL RULES

THIS CONTEST IS OFFERED ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES INCLUDING WASHINGTON DC, WHO ARE LOCATED IN THE U.S. AT THE TIME OF ENTRY. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

ELIGIBILITY: Contest is offered only in the United States to legal residents of the 50 United States at least 18 years old at time of entry. Employees, officers and directors of SJ Creations, Inc. ("Sponsor") and its parent companies, subsidiaries, affiliates, partners, dealers, advertising and contest agencies, manufacturers or distributors of contest materials and their immediate families (parents, children, siblings, spouse) and/or members of the same household (whether related or not) of each are not eligible to enter. All applicable federal, state, and local laws and regulations apply. By entering you agree to these Official Rules and the decisions of Sponsor or its designee, which are final and binding in all respects.

PROMOTIONAL PERIOD: Promotional period varies per event and is specified on the official web page of each contest.

INFORMATION: By participating, you hereby acknowledge and agree to receive e-mail from Sponsor, but can opt out of receiving future email by following the instructions contained in any such email, or otherwise notifying the sending entity.

TO ENTER:

To submit a design for the contest access the SJ Creations Label Design Contest home page and follow the registration procedures stated.

DESIGN CONTEST RULES:

• All entries must be original; and they must be the work and property of the entrant. They must not have been published, broadcast, or otherwise publicly distributed previously, and must not infringe on any third party rights.
• We accept no responsibility for any entrants’ designs including, but not limited to, wording or images used. We are not liable for any copyright infringement on the part of the entrant and will not become involved in copyright disputes.
• The judges decisions are final. Artwork cannot be returned to the entrant after submission.
• One entry per person or group. Multiple entries will automatically disqualify the entrants.
• By entering the competition the designer agrees to transfer or cede all commercial and non-commercial rights and property interests in the artwork to SJ Creations and/or its affiliated organizations for free use, in any manner, in perpetuity.
• SJ Creations undertakes to acknowledge/credit the artist(s), whenever appropriate and possible in the context of such use.
• SJ Creations reserves the right to:

  * suggest and implement modifications/amendments to the original design;

  * organize translations or renditions of the winning caption in other languages;

  * add the logo of SJ Creations.

• Although not required to do so, but in so far as possible and practical, SJ Creations undertakes to carry out such modifications or amendments in close co-operation and consultation with the winning designer(s) on the basis of mutual trust and confidence.
• There will be no royalties or compensation awarded to the winner other than the items listed as the Label Design Contest grand prize.
• SJ Creations will not sell or use submitted artwork for any purpose other than what is listed on the Label Design Contest homepage

Mechanically reproduced entry forms or entry forms that have been tampered with will be disqualified. Entries must be received by the specified deadline per event.

VOTING:Voting to take place 10/1/2011 – 10/31/2011 on the SJ Creations Label Design Contest Page.The design that has the most votes at the end of the month will be selected as the Grand Prize Winner.

Designer Grand Prize Restrictions:Winning design will be shared with our national retail buyer and could be seen on store shelves across the country — SJ Creations cannot guarantee that the buyer will select every design that is presented. SJ Creations has the right to alter any file at their discretion for the purpose of presenting to the buyer. SJ Creations will require the editable files from the winner in order to present their design to the buyer.

TIE:In the event of a TIE - the SJ Creations staff will hold a blind vote to decide the winner of the grand prize. The runner up will receive a prize determined by the SJ Creations staff.

VOTER PRIZE DRAWING: Within 7 days after the end of the Entry Period, Sponsor will choose Winner(s) randomly from all eligible Entries received. Winners will be notified by email, phone, overnight mail or regular mail on or about the day of selection. Limit one prize per household. If winner does not claim prize within 7 days, winner will be disqualified.

ITEM: No substitutions, in the case of unavailability of the Item, Sponsor reserves the right to substitute an Item of equal or greater value. Odds of winning depend on the number of eligible entries received. No assignment, transfer, or substitution of prize is permitted. Taxes are solely the responsibility of winner.

GENERAL CONDITIONS: If prize notification or prize is returned as non-deliverable, or if winner is found not to be eligible or not in compliance with these Official Rules, disqualification may result. By accepting prize, where permitted by law, winners grant to Sponsor and those acting with Sponsor's permission, its parents, subsidiaries and related companies, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's full name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration, and without notice, approval or review. Winners also, without additional compensation, will appear for any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews, as may be determined from time to time by Sponsor. By accepting prize, winners agree that any grant of permission to use the winner's name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by Sponsor electronically, for example by email, and such email secured permission will have the same fore and effect as if that permission has been secured in a written document which was physically executed by the winner. Further, each participant and winner releases and agrees to hold harmless Sponsor, their parents, affiliates, subsidiaries advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any contest related activity, or participation in their contest. Void where prohibited. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the contest or website; to be in violation of the Terms of Service of the website, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry or registration methods will be void all such entries by such methods, and disqualify any entrants using such methods. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the contest at the actual time of entry will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning email, addresses or the domain associated with the submitted email address. Sponsor may prosecute any fraudulent activities to the full extent of the law.

Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in the sol opinion of Sponsor, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this contest and select the winners from entries received prior to the action taken or in such other manner as Sponsor may deem fair and appropriate. IN NO EVENT WILL SPONSOR, SJCREATIONSINC.COM, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SJCREATIONS INTERNET SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSING OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABLILYT, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABLILTY FOR INCIDENTAL OR CONSEQUENTIAL

DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATION OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

DISPUTES: Under no circumstances will entrants be permitted to obtain awards for, and each hereby waives, all rights to claim punitive, incidental and/or consequential damages, and/or any other damages, including attorney's fees or other such related costs of pursuing a claim. The laws of the State of Texas, excluding its conflicts-of-law rules, shall govern these Official Rules. You expressly agree that exclusive jurisdiction for any claim or dispute with SJ Creations or relating in any way to your use of the SJ Creations web site or these Official Rules resides in the courts of the State of California, and you further agree and expressly consent to exercise of personal jurisdiction in the courts of the State of California, in connection with any such dispute and including any claim involving SJ Creations or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunications providers, and content providers.
